1. DISEASE CURE DEADLINE EXTENSION!!

Today, June 15, 2007, the District Court entered an Agreed Order Resetting Disease Cure Deadlines. A copy of the Order is being posted on the CAC website and should be available for viewing or download ASAP (www.tortcomm.org, click on “Court Orders.”)

The Order extends all disease cure deadlines that have or will run by April 1, 2008 are reset to April 2, 2008. The Order also provides that the SF-DCT shall release more complete information about claims criteria. Excerpts from the Order provide:

a)	Polymyositis (PM)and Dermatomyositis (DM) Claims. The first publication of information on or before October 1, 2007 shall pertain to claims reviewed for Polymyositis (PM) and/or Dermatomyositis (DM) . Claimants who have received a Notification of Status letter from the SF-DCT stating that the SF-DCT reviewed their claim for PM and/or DM and that it was deficient AND whose cure deadline has or will run on or before April 1, 2008, (“Covered PM/DM Claimants”) will receive a new cure deadline of April 2, 2008 for the PM and/or DM claim. This is the final cure deadline for Covered PM/DM Claimants. Covered PM/DM Claimants who do not cure their deficiency on or by April 2, 2008 will have their PM and/or DM claim denied pursuant to Section 7.09(b) of the Settlement Facility and Fund Distribution Agreement.
b)	Primary Sjogren’s Syndrome (PSS), Mixed Connective Tissue Disease (MCTD), and Overlap Syndrome (OS). On or before November 1, 2007, the SF-DCT shall release information in the manner described above concerning Primary Sjogren’s Syndrome (PSS), Mixed Connective Tissue Disease (MCTD) and Overlap Syndrome (OS) claims. Claimants who received a Notification of Status letter from the SF-DCT stating that the SF-DCT reviewed their claim for PSS, MCTD and/or OS and it was deficient AND whose cure deadline has or will run on or before May 1, 2008, (collectively Covered PSS/MCTD/OS Claimants”) will receive a new cure deadline of May 2, 2008 for the PSS, MCTD and/or OS claim. This is the final cure deadline for Covered PSS/MCTD/OS Claimants. Covered PSS/MCTD/OS Claimants who do not cure their deficiency on or by May 2, 2008 will have their PSS, MCTD and/or OS claim denied pursuant to Section 7.09(b) of the Settlement Facility and Fund Distribution Agreement.
c)	Systemic Sclerosis (SS) and Systemic Lupus Erythematosis (SLE) Claims. On or before December 3, 2007, the SF-DCT shall release information in the manner described above concerning Systemic Sclerosis (SS) and Systemic Lupus Erythematosus (SLE) claims. Claimants who received a Notification of Status letter from the SF-DCT stating that the SF-DCT reviewed their claim for SS and/or SLE and it was deficient AND whose cure deadline has or will run on or before June 3, 2008, (collectively “Covered SS/SLE Claimants”) will receive a new cure deadline of June 4, 2008 for their SS and/or SLE claim. This is the final cure deadline for Covered SS/ SLE Claimants. Covered SS/SLE Claimants who do not cure their deficiency on or by June 3, 2008 will have their SS and SLE claim denied pursuant to Section 7.09(b) of the Settlement Facility and Fund Distribution Agreement.
d)	General Connective Tissue Symptoms (GCTS), Atypical Neurological Disease Syndrome (ANDS) and Atypical Connective Tissue Disease (ACTD/NAC/ARS). On or before January 7, 2008 the SF-DCT shall release information in the manner described above concerning General Connective Tissue Symptom (GCTS), Atypical Neurological Disease Syndrome (ANDS), and Atypical Connective Tissue Disease (ACTD) claims. Claimants who received a Notification of Status letter from the SF-DCT stating that the SF-DCT reviewed their claim for GCTS, ANDS and/or ACTD and it was deficient AND whose cure deadline has or will run on or before July 1, 2008, (collectively, “Covered GCTS/ANDS/ACTD Claimants”) will receive a new cure deadline of July 2, 2008 for their GCTS, ANDS and/or ACTD claim. This is the final cure deadline for Covered GCTS/ANDS/ACTD Claimants. Covered GCTS/ANDS/ACTD Claimants who do not cure their deficiency on or by July 2, 2008 will have their claim denied pursuant to Section 7.09(b) of the Settlement Facility and Fund Distribution Agreement.

If a claimant has had a disease claim reviewed for more than one eligible disease or condition and/or has more than one cure deadline for these diseases/conditions, she will be given a cure deadline for each disease/condition, as determined by the SF-DCT. The SF-DCT shall notify affected claimants or their Attorney of Record regarding the specific cure deadline that applies to their claim and that the extension shall be their final cure deadline. Nothing in this Order is intended to shorten any claimant’s disease cure deadline of one year as provided in the Settlement Facility and Fund Distribution Agreement, §7.09(b). Nothing in this Order extends or is intended to extend the cure deadline specified at Section 7.09(b) of the Settlement Facility and Fund Distribution Agreement for any claimant other than a claimant defined herein as a Covered PM/DM Claimant; a Covered PSS/MCTD/OS Claimants, a Covered SS/SLE Claimant, or a Covered GCTS/ANDS/ACTD Claimant.

DEADLINES TO FILE CLAIMS

Please mark your calendar with the claim submission deadlines. Please note that most of these deadlines mean that your claim forms and materials must be received by the appropriate entity by the posted deadline. Please mail all forms early enough so that they are received by the deadline listed below. If your claim form is not received by the deadline listed below, you will not be permitted to file a claim later.

If you have a PM/DM claim with a later cure deadline, then the later deadline shall apply to your claim. A cure deadline is not the same thing as a deadline to submit a new disease claim.
May 2, 2008	Cure Deadline for Primary Sjogren’s Syndrome (PSS), Mixed Connective Tissue Disease (MCTD) and Overlap Syndrome (OS) Claims – please note that this cure deadline apply only to those claims that have been reviewed for PSS, MCTD and/or OS, are deficient and who were given a cure deadline of April 1, 2008 or earlier by the SF-DCT. If you have a PSS, MCTD and/or OS claim with a later cure deadline, then the later deadline shall apply to your claim. A cure deadline is not the same thing as a deadline to submit a new disease claim.
June 3, 2008	Cure Deadline for Scleroderma (SS) and Systemic Lupus Erythematosus (SLE) Claims – please note that this cure deadline apply only to those claims that have been reviewed for SS and/or SLE, are deficient and who were given a cure deadline of April 1, 2008 or earlier by the SF-DCT. If you have a SS and/or SLE claim with a later cure deadline, then the later deadline shall apply to your claim. A cure deadline is not the same thing as a deadline to submit a new disease claim.
July 2, 2008	Cure Deadline for General Connective Tissue Symptoms (GCTS), Atypical Connective Tissue Disease (ACTD) and Atypical Neurological Disease Syndrome (ANDS) Claims – please note that this cure deadline apply only to those claims that have been reviewed for GCTS, ACTD and/or ANDS, are deficient and who were given a cure deadline of April 1, 2008 or earlier by the SF-DCT. If you have a GCTS, ACTD and/or ANDS claim with a later cure deadline, then the later deadline shall apply to your claim. A cure deadline is not the same thing as a deadline to submit a new disease claim.
