1. CURE DEADLINES EXTENDED FOR CERTAIN DISEASES

On December 12, 2007, the District Court signed the “Agreed Order Modifying Certain Final Disease Cure Deadlines.” The Agreed Order applies only to persons who have received a deficiency notice from the SF-DCT on their disease claim for one of the following diseases or conditions: Scleroderma, General Connective Tissue Symptoms (GCTS), Atypical Neurological Disease Snydrome (ANDS), Systemic Lupus, and/or Atypical Connective Tissue Disease (ACTD). Listed below are the new dates for release of claim criteria and new cure deadlines. Please read the Agreed Order carefully for further information. A copy of the Agreed Order is available on the CAC’s website (www.tortcomm.org) under the heading “Court Orders.”

2. DISEASE OPTION 1 BACKLOG REDUCED TO 6-7 WEEKS

The SF-DCT recently reported that it had substantially reduced the backlog to process Disease Option 1 claims. The wait time now is approximately 6-7 weeks. Please note that this wait time may change depending on the number of new disease claims filed and the number of requests for “Re-Review” of deficient claims that are filed in the future.


3. NO REJECTIONS RECEIVED FOR THE NOI SETTLEMENT

The Settlement Facility mailed information about the NOI settlement to all eligible NOI claimants or their attorneys on October 19, 2007. The deadline to file a written rejection was December 19, 2007. No rejections were received. The SF-DCT has begun to process Proof of Manufacturer, Explant, Rupture and Disease claims for NOI claimants and will issue the first batch of payments in early February 2008. Approved claims will continue to be paid on a monthly basis thereafter.


4. COURT APPROVES THE OTHER PRODUCTS CONSENT ORDER (CLASS 9 and 10)

On December 12, 2007, the District Court entered an order approving the “Consent Order To Establish Guidelines For Distributions From, And To Clarify The Allocation Of, The Covered Other Products Fund.” The Consent Order authorizes the SF-DCT to make distributions of “Additional Payments” and “Premium Payments” to claimants in Classes 9 and 10 (10.1 and 10.2) who have an approved Medical Condition claim. Class 9 and 10 claimants who received an Expedited Release Payment are not eligible for the Additional and Premium Payments.

5. SETTLEMENT FACILITY PAYMENTS TO CLAIMANTS THROUGH NOVEMBER 30, 2007 TOTAL $939,797,496

Through November 30, 2007, the Settlement Facility has approved and paid almost 100,000 claims totalling $939,797,496. Of this, approximately $920 million has been paid to Dow Corning breast implant claimants.

Proof of Manufacture Reviews for Classes 5, 6.1 and 6.2

Through NOVEMBER 30, 2007, the SF-DCT has received 75,057 Proof of Manufacturer claim forms in Classes 5, 6.1 and 6.2 (Dow Corning Breast Implant Claims). Of this number, 61,136 or 81% have acceptable proof of at least one Dow Corning breast implant. Of the 61,136 Dow Corning claimants, over 33% (one-third) or 20,598 women have been approved for a Rupture claim for their Dow Corning silicone gel breast implant.

Note: The approval percentages for Disease Options 1 and 2 include those claims that were previously approved by the MDL 926 Claims Office and are “pass through” claims in the Settlement Facility (i.e., the claimant had an implant from Bristol, Baxter or 3M and a breast implant from Dow Corning and has applied to receive 50% of her disease award in the Dow Corning case). As a result, the percentage of approved Disease claims processed by the Settlement Facility is actually lower.

Class 7 – Silicone Gel Material Claims

Approximately 11,585 claimants in Class 7 – Silicone Gel Material Claims – have been approved for either an Expedited Release Payment ($600) or a Disease Cash-Out Offer ($3,000). Total payments to date from the Class 7 Fund are $15.5 million. The total fund is $57.5 million NPV. The Settlement Facility continues to review Proof of Manufacturer claims in Class 7 and expects to complete all Proof of Manufacturer reviews within the next year. As Proof of Manufacturer claims are approved, the Settlement Facility will send either the Expedited Release Payment to claimants who selected this option or a Disease Cash-Out Offer to claimants who selected the disease review. There are approximately 11,336 Proof of Manufacturer files pending review, and 1,729 Disease claims pending review. At this time, the SF-DCT is not processing Class 7 Disease claims.

6. SF-DCT RELEASES NEW LIST OF APPROVED AFFIRMATIVE STATEMENTS REGARDING EXCLUSIVE USE OF DCC BREAST IMPLANTS AS OF NOVEMBER 29, 2007

On November 29, 2007, the SF-DCT released an updated list of doctors whose statement about their exclusive use of Dow Corning breast implants are being accepted by the SF-DCT. The SF-DCT reports that this list may continue to change in the future as Class 7 claims are reviewed and conflicting information about a doctor’s exclusive use of Dow Corning breast implants is noted.

7. LATE CLAIMS UPDATE

Certain late claimants who filed a late claim request with the Court dated on or before June 1, 2007 and received by the court on or before June 5, 2007 are being given an opportunity to participate in the Settlement Facility. On December 12, 2007, the District Court entered an order approving a settlement reached by the CAC and Dow Corning that offers late claimants in Groups 1 – 7 whose claim has not been otherwise dismissed or withdrawn an opportunity to file a claim and receive limited benefits provided they meet the eligibility and claim criteria in the Joint Plan. A copy of the order is available on the CAC’s website (www.tortcomm.org). Please note that no new late claim requests will be accepted. The settlement applies only to late claim requests in Groups 1 – 7. The deadline for late claimants to file a claim for benefits is January 21, 2009. Please note that this deadline does NOT apply to timely filed and NOI claimants.


8. PENDING MOTIONS

We realize that there are a number of motions that have been fully briefed and argued that are pending with the District Court. We do not have any information on when the court may rule. We will continue to inquire about when claimants may expect a ruling and/or payment on their disputed claims.


9. DEADLINE REMINDERS!

Please mark your calendar with the claim submission deadlines. Please note that most of these deadlines mean that your claim forms and materials must be received by the SF-DCT by the posted deadline. Please mail all forms early enough so that they are received by the deadline listed below. If your claim form is not received by the deadline listed below, you will not be permitted to file a claim later.
