1. SF-DCT RELEASES CLAIMS CRITERIA INFORMATION FOR POLYMYOSITIS AND DERMATOMYOSITIS CLAIMS

Pursuant to an Agreed Order Resetting Final Disease Cure Deadlines entered by the Court on June 15, 2007, the SF-DCT is releasing claims criteria information for two eligible diseases in the Plan: Polymyositis and Dermatomyositis. A copy of the document is available on the CAC website (www.tortcomm.org) under the heading “Disease Claims” or on the SF-DCT website (www.sfdct.com). Claimants and attorneys affected by the cure deadline extension for Polymyositis or Dermatomyositis will be sent a new Notification of Status letter from the SF-DCT with a final cure deadline for these claims.

The CAC is continuing to work with the SF-DCT about release of additional disease and disability criteria. The Agreed Order provides that the SF-DCT will release claims criteria information on Primary Sjogren’s Syndrome (PSS), Mixed Connective Tissue Disease (MCTD) and Overlap Syndrome (OS) on or by November 1, 2007.

2. CLAIMS PAYMENT AND PROCESSING REPORT

The Settlement Facility has released information about the status of claims processing and payment through AUGUST 31, 2007. The information is summarized below.

Through AUGUST 31, 2007, the Settlement Facility has received 75,021 Proof of Manufacturer claim forms in Classes 5, 6.1 and 6.2. Of the 75,021 claims, 60,752 or 81% have acceptable proof of a Dow Corning breast implant.

Through August 31, 2007, the SF-DCT has issued payment to claimants in Classes 5 and 6 (Dow Corning breast implant claimants) totaling approximately $889 million, including almost $400 million in approved rupture payments.

Note: The approval percentages for Disease Options 1 and 2 include those claims that were previously approved by the MDL 926 Claims Office and are Opass through O in the Settlement Facility (i.e., the claimant had an implant from Bristol, Baxter or 3M and a breast implant from Dow Corning and has applied to receive 50% of her disease award in the Dow Corning case). As a result, the percentage of approved Disease claims processed by the Settlement Facility if actually lower.

3.UPDATE ON NOI CLAIMS SETTLEMENT STATUS

As noted in prior CAC e-newsletters, there has been a settlement that now allows timely NOI claimants to apply for and, if eligible, receive benefits for Explant and Rupture. The SF-DCT is preparing to mail information about this settlement to timely NOI or Conditional claimants in the next few weeks.

The deadline for timely NOI claimants covered by the settlement to apply for Explant and Rupture benefits is October 20, 2008. This means that timely NOI claimants who want to recover for Explant ($5,000 U.S.) and/or Rupture ($20,000 U.S. Base Payment) must have their Dow Corning breast implants removed and their claim forms submitted to the SF-DCT by October 20, 2008. Please note that this deadline applies ONLY to NOI claimants. It does not apply to timely filed claimants.

NOI Claimants who are eligible and who want to accept the settlement now can sign and submit an “NOI Acceptance Form.” A copy of this form will be on the CAC website’s Home Page and also under the heading of “Rule 3005/Notice of Intent Issues.”

4.NEW LIST OF ACCEPTABLE AFFIRMATIVE STATEMENTS FOR DOW CORNING PROOF OF MANUFACTURER

On August 17, 2007, the SF-DCT made the following list of doctors available who have submitted an affirmative statement about their exclusive use of Dow Corning breast implants during the specific time frames listed.

5. DEADLINE REMINDERS!

Please mark your calendar with the claim submission deadlines. Please note that most of these deadlines mean that your claim forms and materials must be received by the SF-DCT by the posted deadline. Please mail all forms early enough so that they are received by the deadline listed below. If your claim form is not received by the deadline listed below, you will not be permitted to file a claim later.
