DISTRICT COURT ISSUES ORDER APPROVING

PARTIAL PREMIUM PAYMENTS FOR CERTAIN

APPROVED RUPTURE AND DISEASE CLAIMS

 

We are happy to report that the District Court issued an Opinion and Order on December 31, 2013 approving the Finance Committee's motion to make Partial Premium Payments on approved Rupture and Disease Claims in Classes 5, 6.1 and 6.2 (women who have or had a Dow Corning Breast Implant).  The full text of the Opinion and Order will be available on the CAC's website (www.tortcomm.org) as quickly as we can place it there.  The Opinion and Order approves a 50% Premium Payment.  Please note that Premium Payments are only available to women who have or had a Dow Corning breast implant and whose Rupture and/or Disease claim was approved as of the date listed in the motion.  Certain groups of claimants are not eligible for a Premium Payment, i.e., Class 7 – the Silicone Gel Claimants' Fund.

Please remember that this is not a final order. It is almost certain that Dow Corning will appeal the Order to the United States District Court for the 6th Circuit. This means that Premium Payments will NOT be paid while the issue is before the Court of Appeals. We do not know how long an appeal might take, but a reasonable estimate is 9-12 months.  We will post more information as it becomes available.
